Terms of Service

1. Service Description

Pommy.ai ("Platform", "Service") is a SaaS (Software as a Service) platform that enables customer communication and support operations management. The Platform offers AI-powered chatbots, live chat, omnichannel customer support, visitor tracking, analytics, and automation features.

AI-powered features are a component of the service but the entire service does not rely solely on these features. The accuracy of AI responses is not guaranteed, and human oversight is recommended for critical decisions.

2. Account Creation and Use

Users:

  • Must be at least 18 years old or have legal guardian consent to create an account
  • Are required to provide accurate and up-to-date account information
  • Are responsible for the security of their account credentials
  • Are responsible for all activities conducted through their account
  • Must promptly report any unauthorized access
  • May not transfer or share their account with third parties

3. Acceptable Use

Pommy may not be used for:

  • Illegal activities or operations that violate applicable laws
  • Distributing harmful, threatening, harassing, or discriminatory content
  • Spam, unsolicited bulk messaging, or abuse
  • Distribution of malware (viruses, trojans, etc.)
  • Attempts to circumvent or test Platform security mechanisms
  • Activities that disrupt other users' service (DDoS, etc.)
  • Sharing content that infringes intellectual property rights
  • Reverse engineering, extracting source code, or copying the Platform

4. Subscription and Payment

  • The Platform offers subscription plans for different usage levels
  • Fees are billed monthly or annually based on the selected plan
  • Price changes are communicated at least 30 days in advance
  • Service may be suspended if payment obligations are not met
  • Cancellation requests take effect at the end of the current billing period
  • No automatic billing transition occurs after a free trial period (user confirmation is required)

5. Intellectual Property

  • All Platform software, design, logos, and related intellectual property rights belong to Pommy.ai
  • Users retain intellectual property rights to content they upload or create on the Platform
  • Pommy processes user content solely for the purpose of providing the service and does not use it for other purposes
  • A limited, revocable, non-exclusive license is granted to the user for service provision

6. Service Level and Updates

Pommy:

  • Reserves the right to develop, update, and modify Platform features
  • Provides advance notice for planned system maintenance
  • May apply urgent security updates without prior notice
  • Aims to deliver the service with a 99.9% uptime target but does not guarantee uninterrupted operation
  • Notifies users via email for significant feature changes

7. Data Responsibility

Under KVKK and GDPR, the data controller responsibility for end-user (customer/visitor) data managed through the Platform belongs to the organization using the Platform. Pommy acts as a data processor in processing such data.

Organizations are responsible for informing their end users about data processing activities and obtaining necessary legal consents.

8. Limitation of Liability

Pommy:

  • Does not guarantee that AI and automation features will produce specific results
  • Does not accept responsibility for the accuracy, completeness, or suitability of AI-generated responses
  • Is not liable for indirect, incidental, or consequential damages arising from service interruptions, data loss, or technical failures
  • Cannot be held responsible for consequences arising from misuse of the Platform
  • Total liability is limited to the subscription fees paid by the user in the last 12 months

9. Account Suspension and Termination

  • Accounts that violate these terms may be suspended with or without prior warning
  • In case of severe violations (illegal activity, security threats), accounts may be immediately terminated
  • Users may close their account at any time
  • When an account is closed, data is processed in accordance with the retention periods stated in the Privacy Policy
  • Suspended account holders may request a review of their situation

10. Dispute Resolution

These Terms of Service are governed by the laws of the Republic of Turkey. In the event of disputes between the parties, amicable resolution shall be sought first. If no resolution is reached, the courts and enforcement offices of Istanbul shall have jurisdiction.

11. Changes

Pommy reserves the right to update these Terms of Service with prior notice. Significant changes will be announced at least 30 days in advance via email and in-Platform notification. Continued use of the Platform after changes constitutes acceptance of the updated terms.
